These are the terms for using heardofyou.io and buying anything from Heard of You. By requesting a free check, an audit, a project or a monthly plan, you agree to them.
“We”, “us” and “Heard of You” mean the business run by Dasha, a sole proprietor based in the United States. “You” means the person or business buying the service.
1. What the service is
Heard of You checks how often AI assistants (now: ChatGPT, Gemini, Claude, Perplexity and Muse) name your product in answer to fixed buyer questions. It also does work intended to get your product into the sources those assistants read. The tiers are:
- Free check. 5 questions, 3 runs, 5 AIs. A report by email. No charge.
- Audit. 25 questions, 3 runs, 5 AIs, plus a written prescription. $149, or $99 for founding customers.
- Project. The audit plus a fixed deliverables list, re-checks at day 30, 60 and 90, and the promise described on the guarantee page. $799.
- Keep growing. After a project: monthly re-checks and at least one new placement attempt a month, 3-month minimum. $349 a month.
The exact scope of each tier is on the pricing page. For a project, it is also in the written deliverables list you receive on day one. That list is the contract for what we will deliver.
2. Requests, fit and payment
You can pay online through our Stripe checkout, or submit a request form and pay by invoice (card or bank transfer). Either way, we confirm within 2 working days whether we will take the work. We may decline any request, and we will say why; if you have already paid and we decline before work starts, we refund you in full. Work starts when payment is received. The Keep growing plan renews monthly by card after a 3-month minimum and can be cancelled by email after that. Prices are in US dollars and do not include any taxes you may owe.
For keep growing, you are billed monthly in advance for a minimum of 3 months. After that, billing continues monthly until you cancel by email. We will remind you 2 weeks before the minimum term ends.
3. Your part
For a project you agree to:
- give us about an hour at the start;
- if you want that deliverable, provide a list of real customers we may contact once, politely, for a review;
- approve or decline, within a reasonable time, anything that goes out under your name;
- publish the pages we write, or give us a way to.
Where a deliverable waits on you, the clocks in the guarantee pause, as described there.
You confirm that you have the right to represent the product, and that any customer list you give us was collected lawfully and may be used to send the review request you approve.
4. Refunds
Refunds are governed by the guarantee page, which is part of these terms. In short:
- the project fee is refunded in full if a listed deliverable has not shipped by day 90;
- the audit fee is refunded if the report is more than 10 working days late;
- no refund is owed for what an AI does or does not say.
5. No guarantee of AI outputs
AI assistants produce different answers from run to run and change over time. We do not control them. We make no promise that any assistant will mention, recommend, describe accurately, or rank your product.
All figures we report are measurements of a sample at a point in time, not predictions. Any “keep working” commitment is as described on the guarantee page and is not a guarantee of outcome.
6. Clean methods
We will not do the following, and you agree not to ask us to:
- write or buy fake reviews;
- hide text or instructions in pages;
- pay for placement presented as editorial;
- run persona or fake accounts;
- submit you to bulk directories;
- promise a ranking.
If you ask for these, we will decline that part of the work. Our methods are described on the clean methods page.
7. Who owns what
Pages and copy we write for you belong to you once the related invoice is paid in full. You may edit, publish and reuse them without crediting us.
Our methods, question sets, templates, reports and this website remain ours. You may use your reports and saved answers for your own business, including sharing them. You may not resell them or present our method as your own service.
Pitches we send are sent on your behalf and in your name where appropriate. Replies belong to you, and we share them with you in full.
8. Confidentiality and publishing results
We keep your reports, answers, customer lists and correspondence confidential. We do not share them with third parties except as needed to deliver the service (see the privacy page).
Founding customers agree that we may publish an anonymised before and after of their results, including cases where nothing improved. “Anonymised” means without your product name, domain or identifying details, unless you give separate written permission. Other customers’ results are never published without written permission.
9. Limitation of liability
To the fullest extent the law allows, our total liability to you for anything arising from the service is limited to the amount you paid us in the 12 months before the claim.
We are not liable for lost profits, lost revenue, lost data, or indirect or consequential losses. We are also not liable for anything an AI assistant or a third-party website says, does, or declines to do. Nothing here limits liability that cannot be limited by law.
10. Ending the agreement
You can stop a project at any time by email. Refunds are as in section 4.
We can end the agreement if you breach these terms, ask us to use methods we have refused, or do not respond for 30 days. In that case we refund any paid, undelivered deliverable on a fair basis.
Keep growing ends when you cancel after the minimum term, or when we give you 30 days’ notice.
11. Governing law
These terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in [STATE]. Before going to court, both sides agree to try to resolve the matter by email within 30 days.
12. Changes
We may update these terms. The version in force when you paid applies to that purchase. The date at the top is the date of the current version.
